Tillman, 24 was a passenger in a van traveling forward a highway. The van driver attempted to pass a tractor-trailer yet was unable to do in this way The tractor-trailer driver then allegedly mov the vehicle to the left toward the van. Startled, the van driver thrown away control of the van, which left the highway and flipped athwart several times. Tillman suffered closed-head injuries, a torn spinal ligament and splaying of the spine at T11-12 and fractures to an arm and a leg Hc had surgery for the spinal injuries, resulting in postoperative complications, and had several surgeries to repair his arm and leg Tillman used a wheelchair for three month and continues to go through pain and depression. His past medical outlays were about $134,000.

Tillman su the van company, the van driver, the tractor-trailer driver, and the trucking company that confessed the tractor-trailer. Suit against the van driver alleged unsafe driving in traveling too fast and attempting to pass when it was not safe to do in this way Suit against the truck driver alleged negligence in moving to the left without looking. Suit against the van company and trucking company was forward a respondcat superior theory of liability.



Plaintiff did not claim wasted income.

The parties settled at mediation before trial for $1 million.
